Peru’s Ministry of Foreign Trade and Tourism (MINCETUR) has opened a 15-day public consultation on proposed changes to the regulations governing online gambling and sports betting.

The consultation was announced through Ministerial Resolution No. 382-2026-MINCETUR, published in the official gazette El Peruano on 21 October. The draft supreme decree would amend the regulations implementing Law No. 31557, approved through Supreme Decree No. 005-2023-MINCETUR.

The consultation runs from 22 October until 5 November 2026.

The proposed amendments cover operator obligations and prohibitions, supervision and enforcement, operational-data transmission, audits, guarantees, confiscation procedures, and the criteria used to determine fines.

MINCETUR said the changes were intended to improve the clarity, predictability, and effectiveness of the existing regulatory framework, drawing on experience gained since Law No. 31557 and its regulations were implemented.

The draft would clarify requirements applicable to operators authorised to provide remote gaming and remote sports betting platforms, as well as operators of land based sports betting rooms. It would also strengthen MINCETUR’s supervisory and enforcement mechanisms.

Other proposed changes concern the transmission of operational information, audit requirements, guarantees, and authorisation conditions.

It also proposes objective criteria for calculating fines, intended to ensure that penalties are imposed consistently, proportionately, and effectively. The draft reportedly includes factors such as illicit benefit, detection probability, harm caused, intent, market and consumer impact, repeat offending, and the operator’s financial capacity.

The ministry’s General Directorate of Casino Games and Slot Machines (DGJCMT), which regulates, authorises, supervises, and sanctions remote gambling and sports betting nationally, will receive, organise, and assess submissions.

The consultation comes amid a separate debate over taxation of Peru’s regulated online gambling market. Legislative Proposal No. 00519-2026-2031-CD, filed on 6 October and currently in committee, would increase the Selective Consumption Tax (ISC) on remote gaming and sports betting from 1% to 5% of the value of each wager. That bill would leave unchanged the separate tax established under Law No. 31557, which is charged at 12% of the statutory tax base calculated from operators’ monthly net gaming income after the permitted maintenance-cost deduction.
